JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-11-2019 The petitioner has challenged an order dated 19.08.2016 passed by the District Magistrate, Supaul whereby he was placed under suspension contemplating initiation of a departmental proceeding against him. At the relevant point of time, the petitioner was posted in District Public Information Section in the Collectorate of Supaul as Lower Division Clerk. A counter affidavit has been filed on behalf of the respondents from which it transpires that the order of suspension has been revoked after expiry of three months of the
Patna High Court CWJC No.2270 of 2018(3) dt.19-11-2019 2/2 order of suspension as indicated in paragraph 7 of the counter affidavit. It has been stated that the petitioner has been paid subsistence allowance for the period during which he remained under suspension. It also transpires that disciplinary proceeding has also been initiated against the petitioner. Considering the facts stated in the counter affidavit, this writ application, wherein the order of suspension is under challenge, has become infructuous. The petitioner is seeking direction to change the conducting officer nominated for conduct of the departmental proceeding. I do not find any reason to accept the said plea made on behalf of the petitioner. This application is accordingly disposed of as having become infructuous.
