The petitioners apprehend their arrest in Baikunthpur P.S. Case No. 150/2014, registered for the offences punishable under Sections 341, 323, 324, 354, 379, 504/34 of the Indian Penal Code.

Munna Mian is alleged to have entered into the house of the informant Rasida Bibi and tried to outrage her modesty. Petitioners are alleged to have come in the house of the informant and assaulted the informant and her family members. It is submitted that prior to the present case Baikunthpur P.S. Case No. 115/2014 was registered under Section 307 and other Sections of the Indian Penal Code. The husband of the informant assaulted the sister of Munna Mian with knife and

Patna High Court Cr.Misc. No.42366 of 2015 (3) dt.08-12-2015 for that the present case has been lodged. There is no allegation of outraging the modesty of the informant against the petitioners. The injury found on the person of the informant is simple in nature caused by hard-blunt substance.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri R.K. Tripathi, Judicial Magistrate 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No. 150/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
