The petitioners apprehend their arrest in Warsaliganj P.S. Case No. 20/2015, registered for the offences punishable under Sections 467, 468, 471, 414, 419, 420 and 120(B) of the Indian Penal Code.
The informant alleged that some persons were cheating innocent people by showing the scheme to identify the face and get reward. The informant raided the place and arrested one person, namely Vikash Kumar who disclosed the name of another person Shiv Shankar who managed to flee away. It is submitted that the petitioners was not present at the place of occurrence. Vikash Kumar disclosed the name of the petitioners in his confession. Save and except the confession of
Patna High Court Cr.Misc. No.44815 of 2015 (3) dt.22-12-2015 Vikash Kumar, no other tangible material is collected against the petitioners. Nothing has been recovered from the conscious possession of the petitioners.
Learned Additional P.P. Sri M.K. Khare has opposed the prayer for anticipatory bail.
Taking into consideration that the name of the petitioners figured in the confession of Vikash Kumar and nothing has been recovered from the possession of the petitioners, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Warsaliganj P.S. Case No. 20/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
