2. The petitioners have preferred this application for grant of regular bail in connection with Tetarhat P.S. Case No. 32 of 2024 dated 14.03.2024 registered for the offence/s
Patna High Court CR. MISC. No.66668 of 2024(4) dt.16-12-2024 2/3 punishable u/ss 147, 149, 341, 323, 307, 504, 506, 353, 427 of the Indian Penal Code.
3. As per the prosecution case, the petitioners and the co-accused along with the 5-6 unknown miscreants are alleged to have assaulted the police personnel and pelted stones on them causing injuries to them.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners. It is further submitted that as per the injury report, the injury is stated to be simple in nature. The petitioner Manish Kumar has six criminals antecedents, the petitioner Raman Singh @ Shatrudhan Singh has four criminal antecedent and the petitioner Pawan Singh has no criminal antecedent as stated in para 3 of the bail petition. The petitioner Manish Kumar and the petitioner Raman Singh @ Shatrudhan Singh are in custody since 17.03.2024 and the petitioner Pawan Singh is in custody since 31.03.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.66668 of 2024(4) dt.16-12-2024 3/3 of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Tetarhat P.S. Case No. 32 of 2024, with the following condition/s:- (i). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
7. The application stands allowed.
