The petitioners in Cr. Misc. No. 11889/2016 and Cr. Misc. No. 12042/2016 apprehend their arrest in Amas P.S. Case No. 144/15 registered under Section 307 and other sections of the Indian Penal Code and Sections 3/4 of Prevention of Witch (Daiyan) Practices Act.
The informant named the petitioners in the F.I.R. and alleged that the petitioners and others assaulted the informant and his family members making allegation of indulging in occult acts. It is submitted that there is a counter-version being Amas P.S. Case No. 145/15. The doctor found the injuries on the person of the injured as simple in nature.
Considering the the fact that there is a counter-case and both sides sustained injuries and the injuries sustained by the injured from the informant's side are simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, Judicial Magistrate 1st Class, Sherghati (Gaya) in Amas P.S. Case No. 144/15, subject to the
Patna High Court Cr.Misc. No.11889 of 2016 (4) dt.23-06-2016 3/3 conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
