The petitioner has preferred this application for grant of regular bail in a case registered under sections 307 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, accused persons on a motorcycle are said to have come come and resorted to firing 5-6 rounds as a result of which one of the customers in the informant's shop sustained gun shot injury. It is stated that the informant had received threats about 10 months ago. The accused persons escaped.

The name of the petitioner transpired in course of investigation in the confessional statement of a co-accused made before police. No incriminating article has been recovered from the petitioner's possession and inspite of being in custody since 11.6.2021, the petitioner has not been put on T.I. parade and chargesheet has been submitted in the case. The application for bail is opposed by learned APP for the State who submitted that in course of investigation the co-accused Keshav Chauhan had confessed about his own guilt as also about active involvement of the petitioner.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the material that has transpired in course of investigation, the petitioner having remained in custody for more than 1 year 6 months since 11.6.2021 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sitamarhi P.S. Case no. 319 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like
