JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioners and learned counsel for the State as well as learned counsel for the informant. Petitioners apprehend their arrest in a case instituted under Sections 147, 148, 149, 323, 395, 307 of Indian Penal Code and 27 of Arms Act.
The informant alleged that on 05.08.2014 at about 08:30 p.m., the accused persons entered into his house and stole household articles. One of the accused even tried to fire from his pistol.
The petitioners submit that they have been made accused on account of village politics. Furthermore, complaint has been
Patna High Court Cr.Misc. No.11439 of 2016 (2) dt.28-03-2016 2/2 filed after one and half months.
Having regard to the facts and circumstances of the case, in case of arrest/surrender, let the petitioners named above, be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Danapur, District Patna, in connection with Complaint Case No. 1119(c) of 2014, with the condition that they would not physically absent for two consequential dates at a stretch till two witnesses are examined in the trial.
