The petitioner seeks regular bail in Ramgharwa P.S. Case No.39 of 2016 registered for the offence under Sections 489(B) and 489(C) of the I.P.C. Earlier prayer for bail was rejected by this Court vide Annexure-1 with observation that the petitioner may renew his prayer for bail before the trail court itself after framing of charge.

Submission of the learned counsel for the petitioner is that charges have already been framed in this

Patna High Court Cr.Misc. No.41186 of 2017 (2) dt.13-09-2017 2/3 case and he is in custody since 8.8.2016 and ready to abide by the condition imposed on him. He moved the trial court and prayed for grant of bail but the learned trial court has rejected the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of 9th A.D.J., Motihari, in S.Tr. No.489/17 arising out of Ramgharwa P.S. Case No.39 of 2016 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in disposal of trial and make himself
