Mr. Manoj Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 24-02-2023 Let the defect(s), if any, be removed within two weeks from today.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 271 of 2021 lodged under Sections 341, 323, 324, 307, 504, 506, 498A/ 34 of the I.P.C. As per the prosecution case, F.I.R. has been lodged by the father of the informant against 3 members including his sonin-law. It has been alleged that the accused persons have entered in the house of the informant breaking the door and poured petrol and make fire, due to which the daughter of the informant suffered injury.

Patna High Court CR. MISC. No.61901 of 2022(2) dt.24-02-2023 2/2 Learned counsel for the petitioner submits that the entire prosecution story is out and out false. It is completely unbelievable that in the night of 11:30 P.M., a person will go to his Sasural and shall start demanding dowry and for nonpayment shall pour petrol and burn. Counsel submits that the present case has been filed with ulterior motive. He submits that antecedent of the petitioner is clean and he is in custody since 11.06.2022. Counsel submits that husband of deceased is already in custody and the petitioner is Samdhi of the informant. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Motihari in connection with Sangrampur P.S. Case No. 271 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
