2. In this case, the petitioner is seeking regular bail in connection with Session Case No. 52 of 2022 arising out of Kiul P.S. Case No. 78 of 2021, registered for the offences punishable under Sections 302 of the IPC and Section 27 of the Arms Act.

3. As per FIR, the petitioner along with other accused persons, named in the FIR, assaulted the father of the informant with lathi. When the informant reached the place of occurrence, he saw that his father was lying on the ground and blood was oozing out of his body. The informant's father was rushed to the hospital where in course of treatment, he died.

4. The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.79567 of 2023(5) dt.25-07-2024 2/2 the petitioner is innocent and has falsely been implicated in this case. The informant is not the eye-witness to the occurrence. There is nothing against the petitioner and only on the basis of suspicion, he has falsely been implicated in this case. He is under custody since 09.08.2021.

5. The report of the learned trial court sent through letter no. 31 dated 04.07.2024 shows that the argument is being heard by the learned trial court on day-to-day basis.

6. It appears that the trial is on the verge of conclusion.

7. Considering the above-mentioned facts and circumstances, I am not inclined to grant bail to the petitioner, which is hereby rejected.
