JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chainpur P.S. Case No. 284 of 2018, registered for the offences punishable under Sections 324, 302, 120(B) and 34 of the Indian Penal Code and section 27 of the Arms Act.

The informant alleged that while he along with his brother was returning to his home, on the way, three miscreants including this petitioner boarded on motorcycle, came from behind and out of three, two miscreants fired upon the informant's brother, as a result of which, two fire-arm injuries caused on arm and one on his chest. The informant took his brother to the hospital, but on the way, he died. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is

Patna High Court CR. MISC. No.66171 of 2019(4) dt.24-01-2020 2/2 general and omnibus allegation against him. Petitioner is in custody since 10.05.2019 having clean antecedent. Petitioner is named in the FIR and the informant has identified this petitioner as one of the accused persons and there is allegation of firing against the accused persons. Considering the facts aforesaid and nature of allegation against this petitioner, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
