JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Gopalpur P.S. Case No. 91 of 2017 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

Petitioner No.1 is named in the FIR and there is allegation of kidnapping of minor daughter of the informant. Submission of learned counsel for the petitioners is that Annexure-2 disclosed that daughter of informant was recovered and she has stated that there was love affair between her and one Sunil Das and she has married with Sunil Das and they have developed physical relationship also, which is Annexure-4 before the Notari Public and petitioners have falsely

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that the girl was minor. In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-I-cumSpecial Judge (SC/ST/POCSO), West Champaran, Bettiah, in connection with Gopalpur P.S. Case No. 91 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
