Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that this is the second attempt of the petitioner to seek bail. It is next submitted that petitioner had earlier moved before this Court seeking regular bail by filing Cr. Misc No. 51652 of 2024 and the same came to be rejected by an order dated 25-10-2024 taking into consideration the fact that petitioner has antecedent of 10 criminal cases.

Patna High Court CR. MISC. No.66718 of 2025(2) dt.25-02-2026 2/3 accused Ajit Kumar had also approached this Court seeking regular bail by filing Cr. Misc No. 35540 of 2024 and the same came to be rejected by an order dated 20-9-2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. It is further submitted that Ajit Kumar also had antecedent of eight cases. It is also submitted that charges against Ajit Kumar was framed by an order dated 14-5-2025, as such he again moved this Court seeking regular bail by filing Cr Misc No. 44997 of 2025 and the same came to be allowed by an order dated 4-7-2025 with certain conditions. It is next submitted that against the petitioner also charges have been framed by order dated 14-5-2025 and the case of the petitioner, if not akin, is similar to the case of Ajit Kumar. It is further submitted that allegation is of firing at the injured, but then from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of firing is against Dheeraj and petitioner is not alleged to have fired.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner and also taking into consideration the fact that charges against the petitioner have been framed by

Patna High Court CR. MISC. No.66718 of 2025(2) dt.25-02-2026 3/3 order dated 14-5-2025, let the petitioner above named be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Piro P.S. Case No. 440 of 2023.

One of the bailors of the petitioner shall be his father, Sanjay Yadav @ Sanjay Singh @ Sanjay Kumar Singh. 8.

However, it is made clear that if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial or is not appearing in the trial on two consecutive dates without any plausible explanation, in both the events, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
