The petitioner is apprehending arrest in a case registered for the offences punishable under section 380/34 of the Indian Penal Code.
On theft being committed on the house of the informant, leading to registration of FIR against unknown. During investigation, co-accused Kallu Mahto and Ram Pravesh Sah, were arrested from whose possession stolen articles were recovered. The name of the petitioner surfaced on the confession of the co-accused Kallu Mahto and Ram Pravesh Sah, who suggested that one Laptop was taken by this petitioner.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.45179 of 2015 (2) dt.03-11-2015 2/2 that there is no recovery from the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Lalganj P.S. Case No.71 of 2015, pending before the learned CJM, Vaishali.
With the above observation, this application is, accordingly, disposed off.
