The petitioner seeks regular bail in Jandaha P.S. Case No.250 of 2015 registered for the offence under Sections 302, 201/34 of the I.P.C.
Allegation against the petitioner is of causing death to his wife and the case is under Sections 302 and 201/34 of the I.P.C.
Submission of the learned counsel for the petitioner is that material available on record shows that in course of preparation of food the deceased sustained burn injuries thereafter she was taken to the doctor who
Patna High Court Cr.Misc. No.39692 of 2017 (3) dt.13-09-2017 2/2 immediately referred to the P.M.C.H. but she was not taken to the P.M.C.H. by the father-in-law and the husband of the deceased and she died due to infection. He is in custody for 3 1⁄2 months Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner, however, once the charge is framed against this petitioner, trial court shall release him on bail to his own satisfaction. With this observation, this application is disposed of.
