JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Bhabua P.S.Case No.54 of 2016, disclosing offences under Sections 147, 149, 353, 427, 435, 323, 504 and 295 of the Indian Penal Code. Fifteen persons are named in the First Information Report including this petitioner and 500-700 are unnamed. It is alleged against them that they caused obstruction in discharge of the official duty of the police party and they attempted to disturb communal harmony. Allegedly the accused persons were trying to kill the family members of accused of murder, namely, Satwant Patel to whom police wanted to arrest. Considering the fact that the allegation is quite general and omnibus and the petitioner has no criminal antecedent, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on

Patna High Court Cr.Misc. No.13985 of 2016 (2) dt.11-04-2016 furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur (Bhabua), in connection with Bhabua P.S.Case No.54 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
