2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 186, 332, 333, 353 and 307 of the Indian Penal Code and Sections 25(1B)a, 26 and 27 of the Arms Act, registered in connection with Dholbajja (Kadwa) P.S. Case No. 43 of 2022.

3. As per prosecution case, on the basis of secret information, the informant apprehended the petitioner after chase and in course of chasing, petitioner made several round firing upon the police team due to which petitioner also sustained injury at his leg. On search of him, two pistols and live cartridges were recovered from the possession of the

4. The learned counsel for the petitioner has submits that this is the second attempt of prayer of bail as such earlier his prayer was rejected vide order dated 27.03.2023 passed in Cr. Misc. No. 75419 of 2022. He submitted that there is allegation of exchange of firing but not a single person except the petitioner has suffered any kind of fire-arm injury. Petitioner is in custody since 05.06.2022.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as the period of custody undergone by the petitioner, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Naugachia, Bhagalpur in connection with Dholbajja (Kadwa) P.S. Case No. 43 of 2022, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court with a further condition that:- (i) the petitioner shall remain physically present on each and every date as directed by the Court and on his absence
