====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 302 and 201/34 of the IPC. The prosecution story, in brief, is that the dead body of sister of the informant was recovered and thereafter he lodged the case stating that the deceased, who was wife of the petitioner, had strained relationship with her husband and as such she filed a maintenance case and it is alleged that the petitioner has killed the deceased and thrown her dead body. It further appears that the case is of the year 2015. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 10.07.2019. The petitioner has got no criminal antecedent. The

There is no allegation of tampering with the witnesses alleged against the petitioner. The deceased was residing at her Naihar. There was differences between the petitioner and the deceased. Hence, a suspicion has been raised against the petitioner. Neither there is any eye witness to the alleged occurrence nor there is circumstantial evidence to suggest the participation of the petitioner in the present case. Except for this, there is no substantive evidence to suggest the implication of the petitioner in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga, in connection with Darbhanga (Sadar) P.S. Case No. 237 of 2015.
