The petitioner is in custody since 29.05.2017 in connection with Kotwa P.S. Case No. 88 of 2017 for the offence registered under Sections 399, 402 and 414 of the Indian Penal Code and Section 25 (1-B)A, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner was taken into custody on mere suspicion and only a black colour mobile was recovered form his possession. It is further submitted that the arms were recovered from one Azad Alam and not from this petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on
Patna High Court Cr.Misc. No.41410 of 2017 (2) dt.21-09-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kotwa P.S. Case No. 88 of 2017.
