2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code.

3. As per allegation in the FIR,petitioner instigated the neighborhood boys to beat the informant. On his order, accused persons by means of lathi, danda and iron rod assaulted him. It is further alleged that accused persons snatched her belongings and threatened him of dire consequences if he contests the election.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to political rivalry. Allegedly, petitioner is said to be only order

Patna High Court CR. MISC. No.65154 of 2023(2) dt.12-10-2023 2/2 giver, he is not assailant of the informant. Informant was also a contesting candidate in the election. There is case and counter case. Petitioner has got no criminal antecedent and languishing in judicial custody since 29.7.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Dumron (Nay Bhojpur O.P.) PS Case No. 250 of 2023.
