JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-11-2021 The petitioners have approached this Court for a direction to the respondents to ensure payment of honorarium to them as they have been selected as Mahadalit Tola Swayam Sevaks being Mahadalits in various blocks of the District of Saharsa in the year 2009. Despite their serving as Tola Sevaks, they have not been paid their honorarium and they have also not been sent for any training as per the scheme.
It has been submitted on behalf of the petitioners that they had approached the District Education Officer and the District Magistrate, Saharsa for redressal of their grievances but when no order was passed either accepting or rejecting their plea, they were forced to approach the public grievance cell.
The concerned /designated officer dismissed the claim of the petitioners on the ground that according to the information received from the concerned department, the Bihar Education Project has closed all centers for training to Tola Swyam Sevaks.
4/4 No reason has been assigned for rejecting the claim of the petitioners and a general statement has been made that their claim is not tenable.
Under the aforesaid circumstances, the petitioners are directed to approach the concerned District Education Officer for redressal of their grievances in accordance with the Rules of 2018.
Should their grievances be not redressed, they would have an option of approaching the District Magistrate of the concerned district as the Second Appellate Authority. Needless to state that the petitioners shall be made known of their status and the reasons for either accepting or rejecting their claim for being paid honorarium or to be sent for any training for being continued as Tola Sevaks. With the aforesaid direction, the writ petition stands disposed of.
