The petitioner seeks bail in a case registered under Sections 384, 385 of the Indian Penal Code and Sections 25(1b)a of the Arms Act. Allegation is that the petitioner and two unknown persons came at the shop of the informant and made demand of Rs.50,000/- otherwise he would be killed.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.05.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of extortion is denied by the petitioner. One country made pistol

Patna High Court CR. MISC. No.58735 of 2019(3) dt.16-11-2019 2/2 without any cartridge is said to have been recovered. There is no ballistic report in respect of the recovered arms whether the same is fit for use or not.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, West, Muzaffarpur in Paroo P.S. case No.223 of 2019.
