The petitioner seeks pre-arrest bail in connection with Bhorey P.S.Case No.102 of 2014 registered under Section 302/34 of the Indian Penal Code.
It is contended that though the petitioner is named in the FIR, on completion of investigation, the police submitted final form against him while sending one Munilal Yadav for trial. It is further contended that though there is allegations against altogether five named and two unknown persons in the FIR, the postmortem report would reveal that the victim has sustained only three injuries.

Patna High Court Cr.Misc. No.53086 of 2015 (2) dt.07-12-2015 2/2 opposed the application filed on behalf of the petitioner for grant of anticipatory bail. He has submitted that two other accused, namely, Arbind Yadav and Durgesh Yadav, who were also named in the FIR, moved for grant of anticipatory bail before this Court in Cr. Misc. No.21968 of 2015 and Cr. Misc. No.23656 of 2015 respectively, which have been dismissed by a co-ordinate Bench of this Court on 30th June, 2015.
Regard being had to the allegations made in the FIR and the reasons assigned in the aforesaid order dated 30th June, 2015, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his application for pre-arrest bail is rejected. (Ashwani Kumar Singh, J) Md.S./- U T
