The petitioners apprehend their arrest in connection with Udawant Nagar P.S. Case No. 136 of 2015 registered under Sections 341, 323, 324, 325, 307, 379, 354(A), 504, 506/34 and 302 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bhojpur at Ara.
The allegation of informant is that in course of occurrence, the petitioners also caused injuries to his father Brij Mohan Singh. Later on, during the course of treatment, the father of the informant died.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.47066 of 2015 (3) dt.28-01-2016 2/2 petitioners submits that, in fact, occurrence took place due to land dispute in which co-accused Sunny Kumar, son of petitioner no.1 also sustained injuries regarding which a counter case has also been filed.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
