2. The Collectorate of Saharsa had come out with an advertisement in 2006 for appointment against Group 'D' post. The petitioner was an applicant. It is his case that till date, the appointments have not been made on the basis of the said advertisement, though, a panel has been prepared by the Collectorate, on the basis of the said advertisement.

3. The Court finds it difficult to entertain this writ application, filed thirteen years after issuance of the advertisement in 2006, and give effect to a panel which was prepared on the basis of the said advertisement. The petitioner claims that his name

Patna High Court CWJC No.20250 of 2019 dt.19-11-2019 2/2 figures at Sl. No. 495 in the merit list. It is not known as to the number of vacancies which were available on the date of advertisement. The number of vacancies were not mentioned in the advertisement, as is evident from Annexure-1.

4. In such view of the matter, no relief as being sought by the petitioner, can be granted.

5. It is however, disturbing to note, that appointments in Collectorate against Group 'D' post, have not been made in accordance with the procedure therefor and rules framed in that regard. The Court would expect from the respondent to ensure taking steps for filling-up the vacancies in accordance with the rules.
