2. In this case, the petitioner is seeking regular bail in connection with Biraul P.S. Case No. 15 of 2023, registered for the offences punishable under Sections 356 and 379 of the IPC, but chargesheet has been submitted under Section 392 of the IPC.

3. As per allegation, when the informant reached to village Balra, two persons on a black Apachi motorcycle along with one another person on another motorcycle overtook the informant and snatched Rs. 5,000/- and a mobile phone.

4. The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot and nothing has

No.66826 of 2024(2) dt.26-09-2024 2/2 been recovered from the possession of the petitioner and his name has figured in the confessional statement of co-accused, Najre Alam who has been granted bail. The petitioner is under custody since 19.03.2024 and there is nothing against him except the cases mentioned in paragraph 3 of the bail application.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Benipur, Darbhanga in connection with Biraul P.S. Case No. 15 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
