The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. On secret information that the petitioner used to sell illegal wine, the police raided a place where 20 litres of 'mahua' wine and 200 litres 'fermented mahua' were recovered. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the place of recovery belongs to the petitioner. It is further submitted that it is an error of record by the learned Sessions Judge that the recovery has been made from the house of the petitioner. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Madanpur P.S. Case No.29/2016, pending before the learned CJM, Aurangabad. With the above observation, this application is, accordingly, disposed off.
