Learned counsel for the petitioners seeks liberty to withdraw the application for anticipatory bail in respect of petitioner no. 2, namely, Ram Nath Gond, the same is granted and application for anticipatory bail in respect of petitioner no. 2 is dismissed as withdrawn.
So far other petitioners are concerned they are apprehending their arrest in connection with Dumraon P.S. Case No. 241 of 2015, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a
Patna High Court Cr.Misc. No.49526 of 2015 (3) dt.15-01-2016 2/2 case and counter case between the parties and that the altercation took place because of the fact that there was 144 proceeding pending over the land which was sought to be ploughed by the petitioner. Learned counsel for the petitioner further submits that the case against these petitioners is false and mischievous as petitioner no. 1 well in the family way and she could not have participated in the altercation.
Considering the nature of allegations made and also the fact that there is case and counter case, let the petitioners, namely, Pramila Devi, Sidhi Gond, Raj Nath Gond, Siri Gond, Bihari Gond, Vijay@ Brijlal Ram and Bachan Ram, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 241 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) sunil/- U T
