====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-02-2024 Heard learned counsel for the petitioner and learned counsel for the Bihar State Food and Civil Supplies Corporation.

2. The present writ petition has been filed for quashing the office order contained in Memo No. 483 dated 15.01.2018 issued under the signature of respondent No.3, namely, the Deputy General Manager, Administration by which

Patna High Court CWJC No.6438 of 2018(2) dt.26-02-2024 2/2 punishment order has been passed in disciplinary proceeding against the petitioner.

Learned counsel for the Bihar State Food and Civil Supplies Corporation submits that the present writ petition is not maintainable as the petitioner has not preferred any appeal against the said order. The appellate authority is the Secretary, Food and Consumer Protection Department, Bihar, Patna.

4. In the light of the submissions made by the parties, this writ petition is disposed off directing the petitioner to avail the remedy before the Secretary, Food and Consumer Protection Department, Bihar, Patna within 60 from today. The Appellate Authority is directed to dispose of the appeal within 90 days from the date of its filing along with a copy of this order with a reasoned and speaking order.
