The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 34, 504 of the Indian Penal Code.
It is alleged against the petitioner that he assaulted with iron rod on the head of the informant as a result of which, he sustained injuries. The other accused persons also assaulted the informant, his wife and daughter-in-law.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.1575 of 2022(2) dt.27-07-2022 2/3 petitioner that the police after investigation has not sent up the petitioner for trial and submitted final form, but differing with the final form, learned Court below took cognizance against the petitioner. The petitioner is Constable in Bihar Police and at the relevant time, he was present at his place of posting at Jamui. There is land dispute between the parties. There is counter version of the occurrence also and both sides received injuries in separate incident. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bhagalpur in connection with Sultanganj
