In this case, the petitioners are apprehending their arrest in connection with Makhdumpur P.S. Case No. 112 of 2017 registered for offences under sections 147, 148, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code.
Already this Court, vide earlier order dated 19.9.2017, has rejected the prayer for anticipatory bail of the petitioner nos. 2, 4 & 5 respectively and, thus, the present application is confined to the petitioner nos. 1 & 3 only. Learned counsel for the petitioners has produced the
Patna High Court Cr.Misc. No.40669 of 2017 (4) dt.31-01-2018 certified copy of the First Information Report from which it appears that the petitioners have not named as an accused persons. The allegation against the petitioner nos. 1 & 3 is with respect to Section 498A and 3/4 of the Dowry Prohibition Act and there is no specific allegation against them Looking to the entire facts and circumstances of the case, let the petitioner nos. 1 & 3, namely, Md. Sonu and Md. Soeb Ahmad @ Guddu, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Jehanabad in connection with Makhadumpur P.S. Case No. 112 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
