The petitioners seek regular bail in connection with Kalyanpur PS case no. 208 of 2019 instituted for the offences punishable under Sections 30(a), 41(i)(ii) of Bihar Prohibition and Excise Act, 2018.

The allegation is regarding recovery of 186 liters of illicit liquor from two vehicles after the same were intercepted by the police and search was made. The petitioners are said to have been arrested from the spot. The learned counsel for the petitioners submits

Patna High Court CR. MISC. No.60771 of 2019(3) dt.16-11-2019 2/2 that the petitioners have been falsely implicated in the present case, they are having clean antecedent and they have got no connection with the vehicle in question, inasmuch as they are not the owner of the said vehicle. The petitioners are said to be languishing in custody since 17.08.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise, Samastipur in connection with Kalyanpur PS case no. 208 of 2019.
