The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 328 and 304B/34 of the Indian Penal Code.

The informant alleged that she had married her daughter to Amit Kumar after marriage, the accused persons were demanding dowry of Rs. 1 lakh and a motorcycle. It is further alleged that on account of non-fulfillment of dowry demand she came to know that her daughter was poisoned and died during the course of treatment.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that it is admitted fact that the

He submits that the petitioner came to be implicated merely because he was neighbour and known to the husband of the deceased. Similarly situated coaccused have been enlarged on bail by a co-ordinate bench of this court vide order dated 06.12.2022 passed in Cr. Misc. No. 39181 of 2022 and vide order dated 12.12.2022 passed in Cr. Misc. No. 42016 of 2022. Petitioner has got no criminal antecedent as mentioned in para-3 of this application.

Learned APP for the State opposes prayer for bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Narpatganj P.S. Case No. 569 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) anand/- U T
