The petitioner apprehends his arrest in connection with C.A. Case No. 2288 of 2016 registered under Sections 376, 511 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that this is a complaint case. On perusal of Annexure nos.- 2 and 3 to the application, it appears that prior to this case, a case was also lodged by the mother of the complainant against brothers of the petitioner for abducting her daughter, which was subsequently withdrawn and on the date of alleged occurrence, petitioner was not present.

No.40674 of 2017 (4) dt.28-11-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Katihar in connection with Complaint Case No. 2288 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
