====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Shikarganj P. S. Case No. 155 of 2025 in a case registered for the offences punishable under Sections 103(1), 80, 238, 61(2) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that marriage of the cousin sister of informant was solemnized with co-accused Deepak Kumar in the year 2023. Thereafter, it is alleged that all the F.I.R. named accused persons, including this petitioner, killed her disappeared the dead body due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that petitioner is only alleged to have assisted the other accused
Patna High Court CR. MISC. No.62561 of 2025(3) dt.10-11-2025 2/2 persons in concealing the dead body. There is no specific accusation of overt act or demand of dowry against the petitioner. Petitioner is maternal uncle of the husband of deceased. He claims clean antecedent and is in custody since 18.06.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sikarhana at Dhaka, East Champaran in connection with Shikarganj P. S. Case No. 155 of 2025.
