ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.07.2019 in connection with Special Case No.6578 of 2019 arising out of Bakhtiyarpur P.S. Case No.244 of 2019 registered for the offence under Sections 328, 120(B) of the Indian Penal Code and Sections 30(a), 30(d) of the Bihar Excise Act. It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner but from the house of Late Arjun Rai. It is further submitted that the petitioner has no criminal antecedents.

Considering the aforementioned facts and

No.60431 of 2019(2) dt.14-10-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna, in connection with Special Case No.6578 of 2019 arising out of Bakhtiyarpur P.S. Case No.244 of 2019.
