Petitioner apprehends his arrest in a case filed under Section 420 of the Indian Penal Code.

As per the allegation, petitioner had collected Rs.1,95,000/- from the complainant for getting employment in Railway. Thereafter, he returned Rs.95,000/- to the complainant but still Rs.1,00,000/- remains to be paid to the complainant. Learned counsel appearing for the petitioner undertakes on instruction that the petitioner would deposit the aforesaid amount of Rs.1,00,000/- within six months. Case No.1824/2011, the above named petitioner, Deepak Kumar Kamal shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri G.K. Yadav, Judicial Magistrate, Purnia subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that at the time of furnishing bail bond, the petitioner would be required to deposit Rs.25,000/-. Thereafter, he will have to deposit the balance amount of Rs.75,000/- in instalment of 15,000/- per month. However, it is made clear that if the petitioner after payment of initial amount does not deposit the subsequent instalments then the court below would proceed to cancel his bail bonds.
