The petitioner seeks bail in a case registered for the offence under Section 414 of the Indian Penal Code. As per the prosecution case, this petitioner alongwith co-accused Chunchun Mishra have been apprehended with stolen pick-up van.

It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner and petitioner has been made accused only on suspicion, while he was standing near a dhaba. Petitioner has got clean antecedent and he is in custody since 24.08.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, East Champaran at Motihari in connection with Kotwa P.S. Case No. 225 of 2021.
