2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 498A, 323, 494 of the Indian Penal Code.

3. As per prosecution case, the complainant was married with the petitioner in the year 1994 and she went to her in-law's house, where she lived peacefully. Thereafter, it is alleged that she was given physical tortured and the petitioner asked her to get Rs. 5 lacs from her father otherwise, she will

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner is the husband of the complainant and marriage was solemnized in the year 1994. Petitioner was blessed with one child out of the wedlock of the complainant. Petitioner was neither tortured the complainant, nor demanded dowry from her. Petitioner is ready to keep his wife (complainant) with full dignity and honour. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 03.05.2023.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Nawada
