Petitioner seeks regular bail in connection with Rampur P.S. Case No. 310 of 2022 registered for the offence punishable under Section 414/34 of the Indian Penal Code. As per the prosecution, the police personnel apprehended this petitioner and co-accused and recovered a stolen motorcycle, mobile phones etc.

The main submissions advanced by the learned counsel for the petitioner are that as per the prosecution's allegation, one motorcycle and mobile phones were recovered from the possession of this petitioner and the same were presumed to be stolen as the petitioner failed to produce the relevant papers of the said materials and the petitioner has been

Patna High Court CR. MISC. No.64036 of 2022(2) dt.27-02-2023 2/2 languishing in jail since 24.06.2022 and he has criminal antecedent of one case in which he is on bail. Learned APP appearing for the State has opposed the bail prayer.

Considering the aforesaid facts and mainly petitioner's custody period and also the fact that the alleged offence of FIR is triable before the First Class Magistrate, a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Rampur P.S.
