1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Babura Police Station Case No. 01 of 2025, dated 27.03.2025, disclosing offences under Sections
2/4 126(2)/115(2)/303(2)/3(5) of the Bhartiya Nyaya Sanhita.

The prosecution case, as per the First Information Report, is that on 26.03.2025, at about 02:00 PM in the afternoon, while the informant's pick-up truck was going towards Chhapra carrying animal bones (fertilizers) for delivery to the Unique Bone Fertilizers factory, run by informant's brother, the petitioners, along with his brother and about 20 other persons, intercepted the pick-up truck of the informant and assaulted the driver and co-driver. The informant's driver informed the informant on his mobile phone, upon which, the accused persons snatched the phone from the driver and demanded a sum of Rs. 20,000/- for releasing the driver, co-driver and vehicle. The informant transferred the demanded amount of Rs. 20,000/- on PhonePe, bearing no. 9470012960 on 26.03.2025.
4. Learned counsel for the petitioners submits that the petitioners are not named in the First Information Report and they have been made accused during course of the investigation. Altogether, 20 persons are alleged to have stopped the vehicle and demanded money. He next submits that the petitioners are 21 years of age, the
3/4 petitioner of the Cr. Misc. No. 61309 of 2025 is having no criminal antecedent, whereas, the petitioner of the Cr. Misc. No. 64179 of 2025 is having one criminal antecedent of the year 2020, in which, he is on bail. He further submits that mobile phone on which the money was transferred by the informant does not belong to the petitioners and from perusal of the impugned order, it appears that the said mobile belongs to one Mantu Kumar.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioners are young aged about 21 years and money was not transferred on the mobile phones of the petitioners, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Babura Police Station Case No. 01 of 2025, subject to the
4/4 condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
