JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-06-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A, 307, 326 and 304B of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The prosecution case is of causing burn injury to the informant by her husband Ram Kumar Mahto and subsequently the informant succumbed to the injuries. It is alleged against the petitioner that in spite of alarm being raised, she did not take any effort to save the informant.

It is submitted by learned counsel for the petitioner that the specific accusation is against the husband of the informant. Moreover, the husband of the petitioner Firan Mahto has been

Patna High Court Cr.Misc. No.20371 of 2016 (3) dt.21-06-2016 2/2 granted regular bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 19010 of 2015.

This Court sees no reason for the learned court below not to consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Andhratharhi P.S. Case No. 35 of 2014 pending in the court of learned JM, 1st Class, Jhanjharpur, Madhubani. Accordingly, the application is disposed of.
