2. The petitioner is in custody registered for the offence under Sections 307 and 384/34 of the Indian Penal Code.

3. As per allegation in the FIR, while the informant refused to make the payment of money, then the accused persons started inflicting knife, due to which the informant sustained cut injury.

4. Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that petitioner neither apprehended at spot nor anything has been recovered from his and also submits that similarly situated co-accused persons, namely, Sunil Pandey and Alok Kumar

Patna High Court CR. MISC. No.73906 of 2023(4) dt.20-03-2024 2/2 have been granted bail by the trial Court and petitioner is in custody since 03.07.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be directed to be released on bail in connection with Brahampur P.S. Case No.222 of 2021 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur.
