JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and the State. The petitioner, who is a woman, apprehends her arrest in Makhdumpur P.S. case no. 96 of 2015 under Sections 406/420 of the Indian Penal Code and Section 4/5 of the Price Chits and Money Circulation Scheme (Banning) Act, 1978. The prosecution case is that on persuasion of petitioner and others, the informant deposited a sum of Rs.2,62,029/- in the account of Jyoti Jan Kalyan Self Help Group, a non-banking organization. It has been further alleged that some other persons have also deposited different amounts in the aforesaid organization.
The petitioner submits that she is not connected with the alleged organization (Chit Fund Company). In course of investigation, it was found that the organization was running in the
Patna High Court Cr.Misc. No.21522 of 2016 (2) dt.20-05-2016 2/2 house of one Rabindra Singh. Furthermore, none of the accounts bear the signature of the petitioner and she is not involved in the said non-banking organization. Learned counsel further submits that co-accused Nagendra Kumar @ Kail Yadav and Prem Kumar with similar allegations have been granted anticipatory bail vide order dated 16.10.2015 passed in Cr. Misc. No. 47337 of 2015 and order dated 28.01.2016, passed in Cr. Misc. No. 4019 of 2016 respectively.
In view of the above, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case no. 96 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Samarendra Pratap Singh, J.) Uday/- U T
