JUSTICE DINESH KUMAR SINGH ORAL ORDER 05/ 11-03-2015 The present application has been filed for modification of order dated 17.12.2012 passed in Cr. Misc. No. 22573 of 2012, whereby petitioner was granted provisional anticipatory bail in connection with Complaint Case No. 1039C of 2010 wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 420, 406 of the Indian Penal Code and 138 of N.I. Act, pending in the court of learned Judicial Magistrate, Ist Class, Saharsa. The petitioner agreed to settle the dispute within a period of three months. The provisional bail was to be confirmed by the learned court below, if the matter is settled between the parties. It is submitted by learned counsel for the petitioner that the bail bond of the petitioner has not been
Patna High Court Cr.Misc. No.211 of 2014 (05) dt.11-03-2015 2/2 cancelled by the learned court below till date. The petitioner undertakes to return Rs.7,00,000/- (Seven lakhs) within a period of two months.
The offer is not being opposed by the learned counsel appearing for the complainant.
In the circumstances, the order dated 17.12.2012 passed in Cr. Misc. No. 22573 of 2012 is modified to the extent that the provisional bail of the petitioner is extended till 15th of May, 2015. The same will be confirmed by the learned court below, if the petitioner will deposit Rs.7,00,000/- (Seven lakhs) before the learned court below prior to that. The said money will be released by the learned court below in favour of the complainant.
Accordingly, the modification application is disposed of.
