The petitioner apprehends his arrest in Excise case No. 86C-3/2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The Excise officials got information that the petitioner was selling liquor in front of his house and on such a raid was conducted. The petitioner fled away but from in front of house of the petitioner 14.400 liters of Indian made foreign liquor was recovered.

The learned counsel for the petitioner submits that recovery was made from a road and not from the conscious possession of the petitioner but it transpired that it was the petitioner who was selling liquor in front of his house and on

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
