19-09-2017 Heard Sri Birendra Kumar, learned counsel for the petitioner and Sri Arun Kumar Pandey, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 21-07-2017 in Parasbigha P.S. Case No. 30 of 2017, corresponding to Excise Case No. 106 of 2017 registered for offence under Section 30(a), (c), (d) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, primarily on the ground that nothing was recovered from his conscious possession. Learned counsel for the petitioner has also drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent.
