04. 03.08.2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Bahadurpur Police Station Case No. 85 of 2012 pending before the Additional Chief Judicial Magistrate, Patna City, Patna, disclosing offences under Sections 143, 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(i)(x) SC/ST Act. From the order passed by learned 1st Additional Sessions Judge, Patna in A.B.P. No. 18893 of 2014, it appears that the petitioner's application for anticipatory bail was rejected by the Court below wayback on 08.08.2014. There is no cogent explanation on record to satisfy as to why the petitioner has approached this Court nearly two years after

Patna High Court Cr.Misc. No.22052 of 2016 (4) dt.03-08-2016 his rejection of anticipatory bail by learned Additional Sessions Judge in the year 2014.

This application is rejected on that sole ground. If the petitioner appears before the Court below within four weeks from today and seek regular bail, his bail shall be considered and disposed of on its own merits preferably on the same day.
