Petitioners seek bail in a case registered for the offence punishable under sections 341, 323, 3451, 354, 366A, 376, 379/34 of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to family dispute. The present complaint case has been lodged after about two and half months of the alleged occurrence without there being any plausible explanation for the delay. Moreover, a joint settlement application (Annexure-2) was filed before the Court below by the parties
Patna High Court CR. MISC. No.66256 of 2019(2) dt.14-11-2019 2/2 2019 to the effect that the matter has been compromised between the parties. Similarly situated co-accused persons have been granted bail vide Annexure-3, 4 and 5. Petitioners have no criminal antecedent. Petitioners are in custody since 04.07.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Nawada in connection with Govindpur P.S. Case No. 70 of 2015.
