JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-09-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected four times vide orders dated 24.03.2014, 18.02.2015, 17.02.2016 and 22.02.2017 passed in Cr. Misc. Nos. 906 of 2014, 41590 of 2014, 53054 of 2015 and 7278 of 2017 respectively, on the ground that the petitioner is in custody since 30.08.2013 and up till now the trial has not been concluded and the petitioner was given liberty to renew his prayer for bail.
The learned A.P.P. on the other hand submits that the deceased before his death has stated as to how he was shot by
Patna High Court Cr.Misc. No.43475 of 2017 (2) dt.13-09-2017 2/2 the petitioner.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with S.Tr. No. 196 of 2014/46 of 2014 arising out of Aurangabad (T) P.S. Case No. 368 of 2013 pending in the court of Special Judge, SC/ST Act, Aurangabad.
However, again the trial court is directed to expedite the trial and to conclude the same as early as possible preferably within a period of two months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, will be at liberty to renew his prayer for bail.
